1) Service Area & Nature of Services
We provide residential and commercial cleaning throughout San Diego County (North County, East County, South Bay, Central). Mobile service only; no walk-in location.
2) Booking, Confirmation & Communication
- Book via web, phone (858-227-6322), or email (glowify@glowifycleanings.com).
- Bookings are subject to availability and are confirmed only after you receive written/email confirmation.
- We may decline or cancel jobs that fall outside our capabilities, safety standards, or service area.
3) Estimates, Scope & Changes
- Prices are in USD and based on your provided details (size, rooms, condition, scope).
- On-site reality controls final pricing. If condition/scope differs materially, we’ll quote adjustments for your approval before continuing.
- Written estimates are not guarantees unless explicitly stated as fixed.
4) Payments
- Due at or before completion, unless otherwise agreed in writing.
- Accepted: Venmo, PayPal, Stripe (cards), Zelle, check, cash.
- Payment method will be confirmed before the appointment; a valid method may be required to reserve your slot.
- Overdue balances accrue 1.5% per month (or the max allowed).
- Chargebacks: we respond with dated photos, notes, GPS logs, and correspondence.
5) Cancellations, Reschedules & Lock-Out
- 24-hour notice required to avoid fees.
- Late cancellation or inability to access the property at the scheduled time (lock-out/no-show) may be charged up to the full service fee.
- These fees are intended as reasonable liquidated damages, not penalties, and reflect lost technician time and route disruption (Cal. Civ. Code §1671—liquidated damages must be a reasonable forecast of harm). Shulman Bastian Friedman Bui & O’Dea LLPAdvocate Magazine
6) Satisfaction Guarantee & 3-Day Warranty (72 Hours)
- Not satisfied? Email glowify@glowifycleanings.com within 72 hours.
- We’ll schedule one free re-clean of the affected areas only.
- Exclusions: new messes after we leave; permanent stains or pre-existing damage; areas outside scope; hazardous/unsanitary conditions.
Misrepresentation Clause
If the property size/condition/scope materially differs from what was provided at booking—or details were falsified/omitted to secure a lower quote—the 3-day warranty may be waived entirely and price adjustments/fees may apply. Examples (non-exhaustive): understated rooms/baths/SF; heavy buildup (grease, mold, pet hair, extreme clutter); booking “standard” when deep/move-out is needed; undisclosed areas (garage/patio/outbuildings); access issues (no parking/locked gates/no utilities); pet mess/odors, pests, hazardous waste; false name/address; seeking warranty for new messes after service.
Exclusive remedy: To the maximum extent permitted by CA law, the re-clean is your sole remedy for quality issues after service is performed. We do not limit liability for willful misconduct, fraud, or violations of law (Cal. Civ. Code §1668; CA Supreme Court confirmed limits can’t shield willful injury). 7) Access, Safety & Right to Refuse
We may refuse or stop work if conditions are unsafe, unsanitary beyond normal cleaning, or outside scope (e.g., biohazard/hoarding/mold remediation/heights beyond safe ladder use). Pets must be secured; we’re not liable for escapes or pet behavior.
8) Breakage, Damage & Fragile Items
- Report alleged damage within 24 hours with photos.
- We are not responsible for pre-existing wear, unstable fixtures, or inherently fragile items unless due to willful misconduct.
- High-value/fragile items must be removed or secured; if you ask us to clean around them, you assume the risk.
- For verified service-caused damage, our liability is the lesser of repair or replacement, not to exceed the amount paid for the service, except where CA law forbids such limits (e.g., willful misconduct). Justia Law
9) Supplies & Customer-Provided Products
We supply professional products and tools. If you require your own products, you assume responsibility for outcomes and safety warnings/instructions.
10) Photos & Documentation
We may take before/after photos for quality control, scope verification, and insurance. Public/marketing use requires your separate consent. Images of people/personal documents are avoided or redacted.
11) Refunds & Guarantees (Summary)
- Because services can’t be “returned,” monetary refunds aren’t offered once work is performed.
- The re-clean (Section 6) is the remedy for quality issues; partial goodwill refunds may be considered only if you end service early.
- CA’s retail refund-signage rule (Civ. Code §1723) applies to retail sellers of goods; we’re a services business. We still publish policies online for clarity and to avoid confusion. Justia LawSacramento County Public Law LibraryCalifornia DOJ
12) Indemnification
You agree to defend, indemnify, and hold harmless Glowify, its managers, employees, and contractors from claims, losses, and costs (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms; (b) your instructions, omissions, or misrepresentations; (c) hazardous conditions at the property; (d) third-party claims related to your acts or property.
13) Privacy & Communications
Your data is handled under our Privacy Policy (CPRA-compliant). By booking, you consent to receive service-related emails, calls, and SMS.
14) Electronic Signatures & Records (E-SIGN/CUETA)
You consent to transact and receive records electronically. Electronic agreements/signatures have the same legal effect as paper signatures, provided records are retainable and accurately reproducible (E-SIGN, 15 U.S.C. §7001; CA UETA, Civ. Code §§1633.1–1633.17). Legal Information InstituteJustia Law
15) Dispute Resolution — Arbitration; No Class Actions
- US Federal Arbitration Act (FAA) governs enforceability (9 U.S.C. §2). Legal Information Institute
- Any dispute not resolved informally will be resolved by binding arbitration in San Diego County, CA, under AAA rules.
- No class actions/class arbitration: claims must be brought individually (FAA preempts state rules hostile to class waivers; AT&T Mobility v. Concepcion, 563 U.S. 333). Justia LawOyez
- McGill carve-out (public injunctive relief): To the extent you seek public injunctive relief under the UCL/CLRA/FAL, such relief cannot be waived and may proceed in court as required by McGill v. Citibank. Justia Law+1Lewis Brisbois
16) Limitations of Liability
To the maximum extent permitted by California law, we disclaim and exclude all indirect, incidental, special, punitive, or consequential damages, and cap our total liability for any claim to the amount you paid for the specific service, except we do not disclaim or limit liability for willful misconduct, fraud, or violations of law (Cal. Civ. Code §1668). Justia Law
17) Force Majeure
We aren’t liable for delays or failures caused by events beyond our reasonable control (e.g., severe weather, accidents, illness, utility outages, government actions). We’ll reschedule promptly.
18) No Waiver; Severability; Assignment; Entire Agreement
- Failure to enforce a term isn’t a waiver.
- If any term is unlawful or unenforceable, the rest remain in effect (reform to the minimum lawful extent).
- You may not assign these Terms without our consent; we may assign to an affiliate or successor.
- These Terms, together with our Privacy Policy and Refunds & Guarantees, form the entire agreement about services.
19) Changes to Terms
We may update Terms at any time; the Effective Date will change. Material changes will be posted; continued use after changes constitutes acceptance.
