Terms of Service, Limited Warranty & Risk Policy

By requesting a quote, booking services, or permitting Glowify Cleanings LLC (“Glowify Cleanings,” “Company,” “we,” “us,” or “our”) to perform services, you acknowledge and agree to the following Terms of Service. These Terms are legally binding and intended to comply with California law, including CCPA/CPRA and relevant consumer protection statutes.

1. Scope of Services

Glowify Cleanings provides residential, move-in/move-out, and short-term rental cleaning services based strictly on the scope selected and the information provided at booking.

We do not provide:

• Restoration, mold, biohazard, bodily fluid, hoarding, or hazardous material cleanup
• Repairs, alterations, or replacement of surfaces or personal property

Services are limited to safe and reasonably accessible areas. Unsafe or obstructed areas may be refused or excluded.

2. Quotes, Accuracy, and Right to Refuse Service

All pricing is based on information you provide. Misrepresentation of:

• Square footage
• Home condition or cleanliness
• Scope or level of service
• Access or restrictions

…may result in:

• Updated or increased quotes
• Reduction of scope
• Immediate cancellation

Any misrepresentation voids the warranty and releases Glowify Cleanings from liability for unmet expectations.

3. Flat-Rate Quote & No Obligation

Upon quote submission:

• A flat-rate quote will be sent via text and email
• You may accept or decline
• There is no obligation until the quote is approved

Quotes are valid only for the service, date, and disclosed conditions.

4. Limited Satisfaction Warranty (3-Day or 5-Day)

Glowify Cleanings provides a limited satisfaction warranty of three (3) or five (5) calendar days, depending on the service.

Warranty Remedy:

• Must submit written notice within the warranty period
• Only applies to areas included in the original scope
• Re-clean is the sole and exclusive remedy

5. Warranty Exclusions (Critical)

The warranty does not cover:

• Pre-existing damage, wear, rust, scratches, or discoloration
• Permanent stains, etching, or buildup
• Fragile, delicate, or improperly installed items
• Areas outside original scope
• Normal wear and tear or pre-existing neglect
• Cluttered or blocked areas
• Issues reported after warranty expiration

Void Conditions:

The warranty is void if:

• Conditions were misrepresented
• Customer obstructs access
• Unsafe or unsanitary conditions exist
• Payment is disputed or reversed
• Instructions ignored or altered post-service

6. No Guarantee of Results

Cleaning results may vary depending on:

• Surface materials
• Age and condition of surfaces
• Pre-existing stains or damage

Glowify Cleanings does not guarantee:

• Complete stain removal
• Restoration of surfaces
• Odor elimination or full eradication of buildup

All services are provided on a commercially reasonable, best-effort basis.

7. Liability Limitations

To the maximum extent allowed by California law:

• Glowify Cleanings is not liable for pre-existing damage
• Liability is limited to the cost of the service performed
• We are not responsible for indirect, incidental, or consequential damages

Nothing in this policy limits legal rights that cannot be waived under California law.

8. Customer Responsibilities & Risk Allocation

Customers are responsible for:

• Securing valuables, cash, jewelry, firearms, medications, sensitive documents
• Notifying Glowify Cleanings of fragile or specialty items
• Ensuring safe working conditions and restricting pets

Glowify Cleanings is not liable for:

• Undisclosed high-value or irreplaceable items
• Normal wear and tear
• Pre-existing damage

9. Fraud, Theft, and Law Enforcement Cooperation

Glowify Cleanings maintains zero tolerance for fraud, theft allegations, or misrepresentation.

Investigation Protocol:

• Internal review of records, communications, photos, video, timestamps, and employee reports
• Coordination with insurance carriers and third-party providers
• Preservation of evidence
• Full cooperation with local, state, and federal law enforcement agencies

Fraudulent Claims:

• Knowingly submitting false, misleading, or exaggerated claims may constitute fraud under California law, including insurance fraud
• Glowify Cleanings reserves the right to:
   
  • Deny fraudulent or unsupported claims
  • Permanently refuse service
  • Refer matters to law enforcement
  • Pursue legal remedies if necessary

All claims must be submitted within 24 hours of service completion and supported by credible evidence.

10. Safety, Access & Right to Stop Work

Glowify Cleanings reserves the right to stop or refuse service if:

• Unsafe or hazardous conditions exist
• Customer or others exhibit abusive or threatening behavior
• Property access is restricted
• Health or safety risks are present

No warranty or guarantee applies if service is incomplete due to safety or access issues.

11. Cancellations & Termination of Service

Glowify Cleanings may cancel or refuse future service for:

• Misrepresentation of property conditions
• Fraudulent activity or false claims
• Abuse, harassment, or threats
• Non-payment or chargebacks

12. Governing Law & Venue

These Terms are governed by the laws of California.

Any dispute must be brought in the appropriate court located in California.

13. Severability

If any provision of these Terms is deemed unenforceable, the remainder remains fully in effect.

14. Acceptance of Terms

By requesting a quote, confirming a booking, or allowing services, you acknowledge that you have read, understood, and agreed to these Terms.
